Albemarle County Adopts First Energy Facilities Regulations

On July 16, 2025, after a 2 ½ year planning and public engagement process, the Albemarle County Board of Supervisors adopted amendments to the County’s Zoning Ordinance establishing the County’s first specific regulations for energy facilities. These new provisions directly address utility-scale solar and battery energy storage facilities, reflecting the County’s goals for renewable energy, land use compatibility, and environmental stewardship.

Berkley Group was engaged by Albemarle County to develop a comprehensive regulatory framework in response to the recognition that the existing zoning ordinance lacked standards for such uses. Our team worked closely with County staff, Planning Commission, and Board of Supervisors to understand the County’s priorities and objectives for utility-scale energy development.

The process included facilitating a dedicated work session with the Planning Commission, discussions with the Board of Supervisors, incorporating staff insights and public feedback, and coordinating with County staff to refine and deliver the final ordinance amendments. Berkley Group and the County’s approach was iterative and collaborative, incorporating input from the Planning Commission, various County departments, the public and vested stakeholders, including representatives of the renewable energy industry and the Charlottesville-based Community Climate Collaborative.

Our work culminated in support for the Board of Supervisors’ final public hearing and deliberations, where we provided guidance on public comments, policy implications, and long-term ordinance administration.
